Conditions of Sale
Version in force as of 23 September 2026.
Article 1 — Your seller and the scope of these Terms
The website amanavintage.fr is operated under the AMANA brand by UTOPIA, a simplified joint-stock company (société par actions simplifiée) with share capital of 200 euros, registered with the Rodez Trade and Companies Register under number 983 883 901, with its registered office at 35 Cité de la Boule d’Or, 12000 Rodez, France. Intra-community VAT number: FR12983883901.
You can contact our customer service at louise@amanavintage.fr, on 05 54 54 81 62, or by post at the registered office address.
These Terms apply to purchases of physical goods made on the Site by an individual acting for purposes outside their professional activity. For these purchases, your contractual seller is UTOPIA, hereinafter “AMANA”.
Transactions in which you sell or consign an item to AMANA fall under a separate buy-back or consignment contract. Purchases made for the needs of a professional activity are subject to adapted conditions.
Article 2 — Our items and their condition
AMANA offers, in particular, second-hand luxury items and accessories. Each listing states the essential characteristics of the item, its condition, any signs of wear, identified defects and the accessories included.
Descriptions and photographs are intended to present the item actually offered. Differences in screen display may alter the perception of colors; this clarification does not diminish our obligation to deliver an item that conforms to its description.
The vintage or pre-owned nature of an item does not remove the legal guarantees. Where a characteristic departs from the legal conformity requirements, AMANA informs you of this specifically and, where the law requires it, obtains your express and separate agreement when the contract is concluded.
AMANA undertakes to sell authentic items. The authenticity documents and accessories included in the purchase are specified in the offer. If you have any doubt about authenticity, contact customer service so that your request can be examined; no general fourteen-day period limits the exercise of your legal guarantees.
Article 3 — Prices and payment
Prices are shown in euros, inclusive of all taxes. Where another currency is offered, the currency and the applicable amount are specified before the order is validated. Delivery costs and any other applicable fees are shown before you commit.
The available delivery countries and methods are those offered for the item and the address concerned. For a destination likely to give rise to import duties or taxes, who bears them and, where they cannot be calculated in advance, whether they may be payable are indicated before purchase. No amount already collected on this basis is invoiced a second time by AMANA.
You may pay using the methods offered at the time of the order. Where split payment is available, its conditions and those of its provider are presented before you make your choice. AMANA does not charge you any surcharge solely because of the payment method used.
Article 4 — Placing an order
Before confirming your purchase, you can review the summary, check the items, quantities, price, contact details and delivery, and then correct any input errors.
Final validation constitutes your obligation to pay. An email confirms the order and sets out the contractual information on a durable medium that you can keep. Confirmation takes place once payment has been validated or in accordance with the terms specific to the chosen payment method.
Some items are available in a single unit only. If an item is found to be unavailable after the order, AMANA informs you without delay and refunds the sums corresponding to the part that cannot be fulfilled, including any fees that are no longer justified. No replacement item or credit note is imposed on you.
Article 5 — Shipping and delivery
Mainland France — Chronopost. Any order for which payment is confirmed before 3 pm on a working day is shipped the same day and, in principle, delivered the next working day. An order paid for after 3 pm, on a Saturday, a Sunday or a public holiday is shipped the next working day. This 24-hour timeframe corresponds to the timeframe announced by the carrier; it may exceptionally be exceeded. In all cases, your order is delivered no later than 5 working days after payment is confirmed.
European Union and rest of the world — UPS. Delivery takes place, in principle, within 3 to 5 working days after shipping, and no later than 10 working days after payment is confirmed, excluding any customs inspection flagged before purchase.
Working days mean Monday to Friday, excluding public holidays in France. The timeframe applicable to your order is displayed before it is validated and repeated in the confirmation. The tracking number is sent to you when the order is shipped.
If the agreed timeframe is not met, contact AMANA. You may exercise the remedies provided by law, in particular requesting delivery within an additional reasonable period and then terminating the contract if delivery does not take place. In the cases provided by law, in particular a refusal to deliver or failure to meet an agreed essential date, you may terminate the contract immediately. The sums due are then refunded within fourteen days of termination.
The risk of loss or damage passes to you when you, or a third party designated by you other than the carrier, take physical possession of the goods, subject to the legal case where you yourself entrust delivery to a carrier not offered by AMANA.
In the event of a damaged or undelivered parcel, please notify us as soon as possible and keep the items useful for examining the case. The absence of reservations with the carrier or of a report within seven days does not remove your rights against AMANA.
Article 6 — Changing your mind: your right of withdrawal
You have fourteen days to notify us of your decision to withdraw, without having to give a reason. For goods, the period begins the day after you, or the third party you have designated, receive them. For an order of several goods delivered separately, it begins after receipt of the last item. The legal rules for calculating and extending time limits apply.
You can notify us of your decision online, using the withdrawal function available at https://amanavintage.fr/pages/renoncer-au-contrat, or by email to louise@amanavintage.fr. You may use the model form provided or any statement clearly expressing your decision. No reason, customer account or prior authorization from AMANA is required to notify your withdrawal.
When you use the online function, you can check the information before confirming submission. An acknowledgment of receipt setting out the content, date and time of your statement is sent to you on a durable medium.
After notification, you have fourteen days to return the goods, unless AMANA offers to collect them. Customer service sends you the shipping label, which shows the return address, together with practical instructions.
Returns are free, whatever the country of delivery, using the label provided by AMANA. If the label cannot be generated automatically for your country, customer service will send it to you. If you prefer to arrange other transport, contact us before purchasing it so that we can agree on how it will be covered. This practical step is not a condition of exercising your right of withdrawal.
Return the item with the accessories and documents received and protect it carefully for transport. We recommend that you keep the original packaging and tags until you have made your decision. Their absence, or the removal of a seal, does not automatically cause you to lose your right of withdrawal.
AMANA checks the identity of the returned item and its condition against the elements of the sales file. This check cannot be used to extend the legal refund deadlines.
You may handle the goods to the extent necessary to examine their nature, characteristics and functioning. Any loss in value caused by handling beyond this examination may engage your liability under the conditions provided by law. Any sum claimed on this basis must be explained and justified; no flat-rate return penalty is applied.
Article 7 — Refund after withdrawal
AMANA refunds the sums concerned, including the initial standard delivery costs applicable to the cancelled sale, no later than fourteen days after receiving your decision to withdraw. The supplement corresponding to a more expensive delivery expressly chosen by you is not refunded.
Unless we offer to collect the goods ourselves, the refund may be deferred until we have recovered them or until we receive proof of their dispatch: the first of these events ends the deferral.
The refund uses the original payment method. Another method, in particular a credit note, is used only with your express agreement and at no cost to you. The cost of the free return organized by AMANA is not deducted from the refund.
For a withdrawal covering part of an order, the treatment of the initial delivery costs takes into account the items kept and the conditions applicable at the time of purchase. The calculation is communicated to you; it creates no additional cost that was not announced before purchase, and no flat-rate return fee is added.
Article 8 — Your legal guarantees
AMANA is liable for lack of conformity defects existing at delivery and appearing within the two years that follow. The guarantee also applies to pre-owned goods. For a pre-owned good, a defect appearing during the first twelve months is presumed to have existed at delivery, unless proven otherwise or incompatible with the nature of the good or of the defect. For a new good, this presumption covers twenty-four months.
This guarantee concerns lack of conformity defects; it is not insurance covering any damage occurring after purchase. The origin of the problem is examined case by case, in compliance with the legal rules of proof.
The remedies include repair or replacement, free of charge, under the legal conditions, and a price reduction or termination of the sale where those conditions are met. The one-of-a-kind nature of a piece may make replacement impossible; it does not remove the other remedies. The legal time limits and extensions apply, in particular the six-month extension in the event of repair under this guarantee.
You also benefit from the guarantee against hidden defects provided for by Articles 1641 to 1649 of the Civil Code. The action must be brought within two years of the discovery of the defect, subject to the other limits provided by law. It may allow you to keep the goods with a price reduction or to return them against a refund.
Send your request to louise@amanavintage.fr, describing the problem and providing the available information identifying the purchase. The fourteen-day limit specific to withdrawal does not apply to these guarantees. The costs necessary for implementing the conformity guarantee are borne by AMANA.
Regulatory notice — legal guarantee of conformity (model A, annex to Article D.211-2 of the Consumer Code)
The consumer has a period of two years from delivery of the goods to obtain implementation of the legal guarantee of conformity if a lack of conformity appears. During this period, the consumer is required to establish only the existence of the lack of conformity and not the date on which it appeared.
Where the sales contract for the goods provides for the supply of digital content or a digital service on a continuous basis for a period of more than two years, the legal guarantee applies to that digital content or digital service throughout the planned supply period. During this period, the consumer is required to establish only the existence of the lack of conformity affecting the digital content or digital service and not the date on which it appeared.
The legal guarantee of conformity entails an obligation for the professional, where applicable, to provide all updates necessary to maintain the conformity of the goods.
The legal guarantee of conformity entitles the consumer to repair or replacement of the goods within thirty days of the request, free of charge and without major inconvenience to the consumer.
If the goods are repaired under the legal guarantee of conformity, the consumer benefits from a six-month extension of the initial guarantee.
If the consumer requests repair of the goods but the seller imposes replacement, the legal guarantee of conformity is renewed for a period of two years from the date of replacement of the goods.
The consumer may obtain a reduction of the purchase price while keeping the goods, or terminate the contract and obtain a full refund against return of the goods, if:
1° The professional refuses to repair or replace the goods;
2° The repair or replacement of the goods takes place after a period of thirty days;
3° The repair or replacement of the goods causes major inconvenience to the consumer, in particular where the consumer permanently bears the costs of taking back or removing the non-conforming goods, or bears the installation costs of the repaired or replacement goods;
4° The lack of conformity of the goods persists despite the seller’s unsuccessful attempt to bring them into conformity.
The consumer is also entitled to a reduction of the price of the goods or to termination of the contract where the lack of conformity is so serious that it justifies an immediate price reduction or termination of the contract. The consumer is then not required to request repair or replacement of the goods beforehand.
The consumer is not entitled to termination of the sale if the lack of conformity is minor.
Any period during which the goods are immobilized with a view to their repair or replacement suspends the guarantee that remained to run until the repaired goods are delivered.
The rights mentioned above result from the application of Articles L. 217-1 to L. 217-32 of the Consumer Code.
A seller who in bad faith obstructs the implementation of the legal guarantee of conformity incurs a civil fine of up to 300,000 euros, which may be increased to 10% of average annual turnover (Article L. 241-5 of the Consumer Code).
The consumer also benefits from the legal guarantee against hidden defects pursuant to Articles 1641 to 1649 of the Civil Code, for a period of two years from the discovery of the defect. This guarantee entitles the consumer to a price reduction if the goods are kept or to a full refund against return of the goods.
Clarification for second-hand goods: for second-hand goods sold by AMANA, the exemption from proving the date on which the defect appeared mentioned above applies to defects appearing within twelve months of delivery (Article L. 217-7 of the Consumer Code). The conformity guarantee remains two years.
Article 9 — Complaints and mediation
For any difficulty, you may send a written complaint to louise@amanavintage.fr or to the registered office of UTOPIA, giving the information needed to understand your request.
After a prior written complaint that has not been satisfactorily resolved, you may use, free of charge, the consumer mediator to which AMANA is subject:
CM2C — Centre de Médiation de la Consommation de Conciliateurs de Justice
Postal address: 49 rue de Ponthieu, 75008 Paris
Website and referral procedure: https://www.cm2c.net
The referral must in particular be made within one year of your written complaint, subject to the other legal admissibility conditions. Mediation is optional and does not deprive you of the possibility of bringing the matter before the competent court.
Article 10 — Personal data
The information needed for orders is processed in accordance with the privacy policy, which sets out in particular the purposes, legal bases, recipients and rights of individuals. You can send your requests relating to personal data to business@amanavintage.fr.
Acceptance of these Terms does not, on its own, constitute consent to commercial prospecting or to processing for which separate consent is required.
Article 11 — Governing law, versions and disputes
These Terms are governed by French law, without depriving the consumer of the mandatory protective provisions applicable in their country of residence where the rules of international law so provide. The competent courts are determined by the rules applicable to consumer disputes; no exclusive jurisdiction of the court of AMANA’s registered office is imposed.
The version applicable to your order is the one presented to you at the time it was concluded. A subsequent update does not retroactively modify that order. If a clause is declared inapplicable, the others remain applicable to the extent permitted by law.
Version and effective date: 23 September 2026.
